General terms and conditions of business
           

1. Scope of application 
   These General Terms and Conditions (GTC) apply to all deliveries and services from Michail Design, owner Michael  Watzinger (hereinafter www.michail-design.com) to consumers. A consumer is any natural person who concludes a legal transaction for a purpose that can predominantly be attributed neither to their commercial nor their independent professional activity. For all orders in my online shop, my copyright under point 10 Copyright Author and Graphic Artist applies.

2. Contracting party 
   The purchase contract is concluded with Michail Design, owner Michael Watzinger, Wattenweiler, Dorfstrasse 15, 86476 Neuburg

3. Conclusion of contract

   1. The display of the images and the ordering of the service does not constitute a legally binding offer, but merely an invitation to order.

   2. Prices are binding and include the applicable VAT.

   3. By clicking the button on www.michail-design.com/shop , you are placing a binding order. Your purchase contract is concluded when we accept and confirm your order by sending an order confirmation or invoice by email or mail immediately after receiving your order.

   4. There is a right to acceptance.
       

4. Right of withdrawal

   1. If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.

   2. If you, as a consumer, exercise your right of withdrawal in accordance with section 4.1, you will have to bear the regular costs of return.

   3. Otherwise, the provisions for the right of withdrawal are set out in detail in the following

      Right of withdrawal 
       
      You have the right to withdraw from this contract within fourteen days without giving any reason. 
       
      The cancellation period shall be fourteen days from the day on which you or a third party designated by you takes possession of the order confirmation. 
       
      To exercise your right of withdrawal, you must inform us [enter name of entrepreneur, address, telephone number and email address] by means of an unambiguous declaration (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You can use the attached model cancellation form for this purpose, but this is not mandatory. You can also electronically fill out and submit the model cancellation form or another unambiguous declaration on our website (insert internet address). If you make use of this option, we will send you a confirmation of receipt of such a cancellation immediately (e.g. by email). 
       
      To comply with the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the expiry of the cancellation period. 
       
      Consequences of cancellation 
       
      If you cancel this contract, we will refund all payments we have received from you promptly and at the latest within fourteen days from the date on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund.

5. Prices

   1. The prices stated on Michail Design www.michail.design.com website include statutory VAT and other price components.

   4. Currently valid payment methods are stated in the shop. Please note point 12.Payment.
       

6. Drawings by Michail

   1. Each drawing by Michail is unique and only available in the online shop. The drawing by Michail was drawn directly by Michail Design Michael Watzinger. It is available in Michail Design online shop at www.michail-design.com .

   2. The price is binding and non-negotiable.

   3. Please also note the section Copyright from point 10.1

   4. Invoicing in the online shop takes place shortly after the order

   5. The shipping method is insured and specified during the order process. A tracking number will be provided.

   6. drawings  by Michail can be picked up or delivered. drawings by Michail can be paid for in the online shop or directly upon delivery. An invoice will be issued.

   7. The drawing by Michail is packaged for shipping to avoid damage to the drawing.

   8. An exchange of the drawing by Michail is excluded; a unique piece cannot be exchanged.

   9. The pictures in the online shop show the drawing by Michail  for sale.

   10. The point of color scheme in the article description is to be noted in the shop.

9. Copyright

   1. All images, photos, drawings, logos, graphics, graphic artworks, monochrome artworks, other graphic art, videos, words and texts are subject to my copyright. This is based on current case law and penalties for infringements that violate applicable copyright law.

   2. Under German law, the Copyright Act (UrhG) applies, as detailed in  the Act on Copyright and Related Rights. You can read the complete UrhG here . Furthermore, European and international law, which protects my interests, applies.

   3. My legal department will pursue and report any violations. I will file lawsuits for injunctions to protect myself so that my media, my works of art, my unique pieces, cannot be reproduced and thus cause financial loss. I live in Germany but am not deterred by international lawsuits that enforce my rights as an author and graphic Artist.

   4. I then transfer to you, upon purchase in my online shop at www.michail-design.com/shop the applicable law and we will effectively invoice you upon successful payment of the equivalent amount. The invoice number, name and date are decisive for the use of the drawing, logos or artistic drawings or illustrations listed in the invoice. The information in the invoice is decisive.

   6. Unique pieces are unique and one-of-a-kind and this is what the Copyright Act and European and international law are intended to protect. This means that my Michail Design works of art remain unique and one-of-a-kind in the whole world.
       

10. Your Support to Michail

    1. Your support to Michail is not a donation but rather a payment and is considered income for tax purposes.

    2. Sales tax is paid on the income and is considered for income tax purposes.

    3. A payment for Your Support to Michail can be made via the website www.michail-design.com.

    4. A receipt can be issued for the payment which contains the tax-relevant data. The sales tax is also listed.

    5. The payment is considered a service. The payment of your support/your support to Michail represents a service, the service is without consideration and includes the website www.michail.design.com in particular the operation of the blog by Michail and the website www.michail-design.com.

    6. The payment options can be found on the website www.michail-design.com/unterstütze-mich .

11. Payment

    1. The invoice or receipt will be sent after the order has been processed in the online shop.

    2. Invoicing will be done promptly.

    3. The payment deadline is 14 days after receipt of the invoice by bank transfer or through payment points 12.8 and 12.9. The details and available payment methods in the online shop at www.michail-design.com/shop are decisive.

    4. If you choose to pay upon delivery, you pay the invoice amount directly to me as soon as I have personally handed over the drawing by Michail, Link by Michail, or your publicity by Michail. You can pay directly by card, payment link or cash. You will receive a receipt for the delivery. As with all items, payment upon delivery requires an order from the online shop at www.michail-design.com/shop. The order in the online shop at www.michail-design.com/shop is decisive.

    5. If the payment deadline is exceeded, reminder fees will be charged. The booking date is decisive.

    6. There are basically several payment options available.

    7. When paying by invoice, the account details stated on the invoice are binding.

    8. When paying using the payment method offered by Stripe, payment processing is carried out by the payment service provider Stripe Payments Europe Limited (1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland; Stripe). The individual payment methods via Stripe are displayed to you under a correspondingly labeled button on our website and in the online ordering process at www.michail-design.com/shop .  Stripe may use other payment services for payment processing; if special payment terms apply, you will be informed separately of these.     9. When paying via the payment service provider Wix Payments, a payment with numerous payment options is provided. The individual payment options can be found in Michail Design Michael Watzinger online shop www.michail-design.com/shop. The additional user agreements of Wix Payments apply and can be found on the site.
        

12. Discounts and vouchers

    1. Discounts and vouchers are indicated on Michail Design www.michail.design.com and are valid in the www.michail-design.com/shop online shop.

    2. Vouchers are available for a limited time in their category, type and duration.

    3. The validity must be observed.

    4. Only genuine and valid vouchers are valid in the online shop. Only valid vouchers and discounts are eligible for a reduction in the invoice amount. Counterfeits and attempted fraud will be prosecuted and reported in accordance with applicable law. 
        

13. Retention of title

    1. The goods, drawings by Michail and digital media remain my property until full payment has been made.
        

14. Dispute participation

    1. The EU Commission has created an internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. Further information is available under the following link:  https://ec.europa.eu/consumers/odr . We are willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board to resolve disputes with consumers (specify the legal norm or contractual agreement). The responsible consumer arbitration board is: Universalschlichtungsstelle des Bundes Zentrum für Schlichtung eV, Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de . To resolve the aforementioned disputes, we will participate in dispute resolution proceedings before this board.
